Article 1 (Purpose)
These Terms and Conditions set forth the rights, obligations, and responsibilities between Wizmobility Co., Ltd. (hereinafter referred to as the "Company") and users (referring to those who have agreed to the WIZMO Service Terms and Conditions, hereinafter referred to as "Users") in using the location-based services (hereinafter referred to as "Services") provided by the Company.
Article 2 (Effectiveness and Changes of Terms and Conditions)
2.1 These Terms and Conditions shall take effect when an individual location information subject who applies for the Services agrees to these Terms and Conditions and registers as a service user following the procedures set forth by the Company.
2.2 If a user clicks the "Agree" button for these Terms and Conditions online, it shall be deemed that the user has read and fully understood the contents of these Terms and Conditions and agreed to their application.
2.3 The Company may revise these Terms and Conditions within the scope that does not violate relevant laws such as the Act on the Protection and Use of Location Information, Content Industry Promotion Act, Act on Consumer Protection in Electronic Commerce, Framework Act on Consumers, and Act on the Regulation of Terms and Conditions.
2.4 When the Company revises the Terms and Conditions, it shall specify the existing terms, revised terms, application date of the revised terms, and reasons for revision, and announce them along with the current terms from 10 days before the application date and for a considerable period after the application date. If the revision is disadvantageous to users, this shall be announced on the service website or notified to users in electronic form (email, SMS, etc.) from 30 days before the application date and for a considerable period after the application date.
2.5 If the Company notifies users as per the previous paragraph and the user does not express their objection within 7 days after the announcement or notification date until the implementation date of the revised terms, it shall be deemed that the user has agreed to the revised terms. If a user does not agree to the revised terms, they may terminate the service agreement.
Article 3 (Application of Related Laws)
These Terms and Conditions shall be applied fairly according to the principle of good faith, and matters not specified in these Terms and Conditions shall be governed by related laws or general practices.
Article 4 (Contents of Services)
The services provided by the Company are as follows:

Article 5 (Service Usage Fees)
5.1 The services provided by the Company are basically free. However, separate paid services can be used only after paying the fees specified for those services.
5.2 The Company may charge service usage fees through methods determined by contracted electronic payment companies or by including them in bills determined by the Company.
5.3 Cancellation and refund of payments made through paid services shall be governed by the Company's payment terms and conditions and related laws.
5.4 Refund requests due to personal information theft and payment fraud, or requests for the payer's personal information may be rejected except as required by law.
5.5 Data communication fees incurred when using wireless services are separate and follow the policies of each subscribed mobile carrier.
5.6 Fees incurred when posting content through MMS, etc., follow the policies of mobile carriers.
Article 6 (Notification of Service Content Changes)
5.1 When the Company changes or terminates service content, it may notify users of the changes or termination through email to registered email addresses, phone numbers, text messages, push notifications, in-app notice boards, etc.
5.2 In case of 5.1, when notifying unspecified multiple users, the Company may notify users through websites or other Company notice boards.
Article 7 (Restriction and Suspension of Service Use)
7.1 The Company may restrict or suspend users' service use in any of the following cases:
⑴ When a user leaks confidential information of Company services or personal information of other users externally;
⑵ When a user intentionally or through gross negligence interferes with the operation of Company services;
⑶ When unavoidable due to service facility inspection, repair, or construction;
⑷ When telecommunications service providers defined in the Telecommunications Business Act suspend telecommunications services;
⑸ When service use is hindered due to national emergency, service facility malfunction, or service use congestion;
⑹ When the Company determines it is inappropriate to continue providing services due to other significant reasons.
7.2 When the Company restricts or suspends service use according to the previous paragraph, it must inform users of the reasons and restriction period.
Article 8 (Location Information Collection Method)
8.1 The Company collects users' personal location information using GPS information collected from devices with built-in GPS chips and LBS platform as follows:

8.2 When the personal location information collection method specified in Paragraph 1 changes, the service provider shall notify in advance through the homepage or separately notify users. However, when prior notification is impossible due to circumstances beyond the service provider's control, notification may be made afterward.
Article 9 (Use or Provision of Personal Location Information)
9.1 When the Company intends to provide services using personal location information, it must first specify this in the terms of use and obtain consent from the personal location information subject.
9.2 The rights of users and legal representatives and their exercise methods shall be under the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing, or residence if there is no address. However, if the user's address or residence is unclear at the time of filing or the user is a foreign resident, the case shall be filed with the court of jurisdiction according to the Civil Procedure Act.
9.3 The Company automatically records and preserves location information use/provision/verification data for Shopper service operation, fee settlement with users, and complaint handling, and maintains such data for 6 months.
9.4 When the Company provides users' location information to Shopper service drivers and administrators, it immediately notifies users through the communication terminal device that collected the location information about the recipient, provision time, and purpose. However, in any of the following cases, notification may be made through a communication terminal device or email address previously specified by the user:
⑴ When the communication terminal device that collected personal location information lacks text, voice, or video reception capabilities;
⑵ When the user has previously requested notification through online posting or other methods.
Article 10 (Rights of Personal Location Information Subject)
10.1 Users may withdraw all or part of their consent for location-based service provision using personal location information and third-party provision of personal location information from the Company at any time. In this case, the Company shall destroy the collected personal location information and verification data of location information use and provision. However, if users withdraw location information consent, they cannot use the Company's services.
10.2 Users may request temporary suspension of personal location information collection, use, or provision from the Company at any time, and the Company cannot refuse this and must have technical means for this purpose.
10.3 Users may request access to or notification of the following materials from the Company, and if there are errors in such materials, may request corrections. In this case, the Company cannot refuse users' requests without justifiable reasons:
⑴ Verification data of location information collection, use, and provision about oneself;
⑵ Reasons and contents of personal location information provided to third parties under the Act on the Protection and Use of Location Information or other laws.
10.4 Users may request the exercise of rights under Paragraphs 1 through 3 through the Company's prescribed procedures.
Article 11 (Rights of Legal Representatives)
11.1 For users under 14 years of age, the Company must obtain consent from both the user and their legal representative for location-based service provision using personal location information and third-party provision of personal location information. In this case, the legal representative has all the rights of users under Article 9.
11.2 When the Company intends to use personal location information or verification data of location information use/provision of children under 14 years of age beyond the scope specified or notified in the terms of use, or provide it to third parties, it must obtain consent from both the child under 14 and their legal representative. However, this excludes the following cases:
⑴ When verification data of location information use and provision is needed for fee settlement related to location information and location-based service provision;
⑵ When information is provided in a form that cannot identify specific individuals for statistical compilation, academic research, or market research.
Article 12 (Rights of Guardians of Children 8 Years or Younger, etc.)
12.1 When guardians of the following persons (hereinafter referred to as "children 8 years or younger, etc.") consent to the use or provision of personal location information for the protection of life or body of children 8 years or younger, etc., it shall be deemed that consent has been obtained from the person themselves:
⑴ Children 8 years or younger;
⑵ Persons under guardianship;
⑶ Persons with mental disabilities as defined in Article 2, Paragraph 2, Item 2 of the Welfare of Disabled Persons Act who are severely disabled persons as defined in Article 2, Item 2 of the Act on the Promotion of Employment of Disabled Persons and Vocational Rehabilitation (limited to those who have registered as disabled persons under Article 29 of the Welfare of Disabled Persons Act).
12.2 Guardians who wish to consent to the use or provision of personal location information for the protection of life or body of children 8 years or younger, etc., must submit to the Company a written consent form with documentation proving their guardianship.
12.3 When consenting to the use or provision of personal location information of children 8 years or younger, etc., guardians may exercise all rights of the personal location information subject.
Article 13 (Designation of Location Information Manager)
13.1 The Company operates by designating a location information manager who can take substantial responsibility for properly managing and protecting location information and handling complaints from personal location information subjects.
13.2 The location information manager is the department head of the department providing location-based services, and specific details follow the appendix to these Terms and Conditions.
Article 14 (Compensation for Damages)
14.1 If users suffer damages due to the Company's violation of Articles 15 through 26 of the Act on the Protection and Use of Location Information, users may claim compensation for damages from the Company. In this case, the Company cannot be exempted from responsibility unless it proves there was no intention or negligence.
14.2 If the Company suffers damages due to users' violation of these Terms and Conditions, the Company may claim compensation for damages from users. In this case, users cannot be exempted from liability unless they prove that there was no intent or negligence on their part.
Article 15 (Disclaimers)
15.1 The Company shall not be liable for any damages incurred by users in cases where services cannot be provided due to the following reasons:
⑴ Force majeure events such as natural disasters or similar circumstances
⑵ Intentional service disruption by third parties who have entered into service partnership agreements with the Company
⑶ Service disruptions due to user's fault
⑷ Cases other than those specified in items 1 through 3 where the Company is not at fault or negligent
15.2 The Company does not guarantee the reliability or accuracy of information, data, or facts posted on the service, and shall not be liable for any damages incurred by users as a result.
Article 16 (Application of Regulations)
16.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Korea.
16.2 Matters not specified in these Terms and Conditions shall be governed by relevant laws and commercial practices.
Article 17 (Dispute Resolution)
17.1 In cases where disputes related to location information cannot be resolved through mutual agreement between parties or where such agreement is not possible, the Company may apply for adjudication to the Korea Communications Commission pursuant to Article 28 of the Act on the Protection and Use of Location Information.
17.2 In cases where disputes related to location information cannot be resolved through mutual agreement between parties or where such agreement is not possible, either the Company or the customer may request mediation from the Personal Information Dispute Mediation Committee pursuant to Article 43 of the Personal Information Protection Act.
